The usual procedure is to send a warning letter. In this, the opponent is requested to cease the illegal behavior and to bear the costs of the warning. Since the fair lasts only a few days, the opponent is given only a very short period of time.

If the cease-and-desist declaration is not submitted, the rights holder will apply for a temporary injunction. Once this has been issued, it must be served on the opponent. It becomes effective upon service. If the opponent continues to act against the cease-and-desist order, an order will be issued against him.

The opponent has the possibility to file an objection against the preliminary injunction or - as far as he acknowledges the infringement - to make a closing statement. In the event of an objection, a date for oral proceedings before the court is set.
